Welcome to TelaVets. These Terms and Conditions ("Terms") govern your access to and use of the TelaVets website, mobile applications, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree, you may not use the Services.

1. About TelaVets

TelaVets provides veterinary telemedicine services, including remote consultations with licensed veterinarians and, where legally permitted, the prescribing and delivery of medications through licensed pharmacies. TelaVets does not replace in-person veterinary care and is not suitable for emergencies.

2. Eligibility

To use the Services, you must:

• Be at least 18 years old.
• Reside in a U.S. state where TelaVets operates.
• Provide accurate, current, and complete information when registering or using the Services.

TelaVets may suspend or terminate your account if eligibility requirements are not met.

3. No Emergency Services

TelaVets is not an emergency service. If your pet is experiencing a life-threatening condition, you should immediately contact a local emergency veterinary hospital.

4. Medical Services & Prescriptions

• Consultations are provided by independent, licensed veterinarians who contract with TelaVets.
• Prescriptions may only be issued when medically appropriate and legally permitted under applicable state law.
• All prescriptions are filled and shipped through licensed third-party pharmacies.
• TelaVets is not responsible for pharmacy delays, shipping issues, or medication errors beyond its control.

5. User Responsibilities

You agree to:

• Provide accurate information regarding your pet's health, history, and condition.
• Follow veterinarian instructions, including recommendations for in-person care.
• Use the Services only for lawful purposes and in compliance with these Terms.

6. Account Registration & Security

You must create an account to access certain Services. You agree to:

• Maintain the confidentiality of your login credentials.
• Accept responsibility for all activities conducted under your account.
• Notify TelaVets immediately of unauthorized access.

TelaVets reserves the right to suspend or terminate accounts that are fraudulent, misleading, or otherwise in violation of these Terms.

7. Fees, Payments, and Refunds

• Fees for consultations and Services are disclosed prior to purchase.
• Payments are processed through secure third-party payment processors.
• Unless otherwise required by law, all fees are non-refundable.
• If applicable, subscription services automatically renew unless canceled in accordance with TelaVets' cancellation policy.

8. Shipping & Delivery of Medications

• Medications are shipped via licensed pharmacy partners.
• Delivery times may vary based on supply chain factors, pharmacy inventory, and carrier availability.
• TelaVets is not responsible for delays, lost shipments, or carrier errors.

9. Intellectual Property

All content available through the Services—including trademarks, logos, graphics, software, and other materials—is owned by TelaVets or its licensors and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without prior written consent.

10. Acceptable Use Policy

You agree not to:

• Misrepresent your identity or your pet's medical history.
• Attempt to obtain medications fraudulently or illegally.
• Harass or abuse veterinarians, staff, or support representatives.
• Interfere with or attempt to disrupt the functionality of the Services.

11. Third-Party Services

TelaVets may integrate with or provide links to third-party services, including pharmacies, carriers, and payment providers. TelaVets is not responsible for the actions, content, or policies of such third parties.

12. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or accuracy.

13. Limitation of Liability

To the fullest extent permitted by law:

• TelaVets, its veterinarians, employees, contractors, and affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages.
• TelaVets' total liability for any claim shall not exceed the total amount paid by you for the Services in question.

14. Indemnification

You agree to indemnify, defend, and hold harmless TelaVets, its veterinarians, employees, contractors, affiliates, and partners from any claims, damages, or expenses arising out of your use of the Services or violation of these Terms.

15. Governing Law

These Terms and your use of the Services shall be governed by the laws of the State of California, without regard to its conflict of law principles.

16. Arbitration & Dispute Resolution

Any disputes arising from these Terms or the Services shall be resolved through binding arbitration conducted on an individual basis in accordance with the rules of the American Arbitration Association.

Class Action Waiver: You agree not to participate in any class action or representative proceeding against TelaVets.

17. Termination of Services

TelaVets may suspend or terminate your access to Services, without notice, if you violate these Terms, engage in fraudulent activity, or misuse the Services.

18. Force Majeure

TelaVets shall not be liable for delays or failures caused by events beyond its reasonable control, including but not limited to natural disasters, acts of government, labor disputes, supply chain interruptions, or internet outages.

19. Assignment

You may not assign or transfer these Terms without prior written consent from TelaVets. TelaVets may assign or transfer its rights under these Terms without restriction.

20. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.

21. No Waiver

Failure by TelaVets to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision.

22. Entire Agreement

These Terms, together with the Privacy Policy and any supplemental agreements, constitute the entire agreement between you and TelaVets with respect to your use of the Services.

23. DMCA & Copyright Complaints

TelaVets respects intellectual property rights. If you believe your copyrighted work has been used in violation of the law, you may send a notice to TelaVets in accordance with the Digital Millennium Copyright Act (DMCA).

24. Changes to Terms

TelaVets reserves the right to modify these Terms at any time. Updates will be effective upon posting. Continued use of the Services constitutes acceptance of the revised Terms.
